Terms & Conditions

1) Terms and Conditions 

These Booking Conditions, together with any other written information we brought to your attention before we confirmed your booking, form the basis of your contract for booking services with Sun Active Tourism Ltd trading as Cyprus Active. Please read them carefully as they set out our respective rights and obligations. In these Booking Conditions references to "you" and "your" include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.   References to ‘arrangements’ in these conditions means the experiences, excursions, activities, transfers, accommodation and any other services featured on our website at  www.cyprusactive.com.

 

By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:-

 

  • He/she has read these terms and conditions and has the authority to and does agree to be bound by them;

 

  • He/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services. 

 

2) Accuracy

We endeavour to ensure that all the information and prices we provide are accurate, however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed.

 

3) Booking

If your booking is more than 30 days before your departure date, you must pay a deposit. If your booking is less than 30 days of your arrival, you must pay the full cost at the time of your booking unless another term is agreed upon between `you` and Sun Active Tourism Ltd.

For regular bookings, the deposit amount required is usually 1/3 of your total booking cost, which will be indicated during your purchase and on your invoice. Sun Active Tourism Ltd has the right to change the required deposit amount or its ratio without any prior notice.

The balance must be paid 30 Days before departure. Sun Active Tourism Ltd has the right to change prices of goods and services as well as its ratios and/or amounts at anytime without any prior warning.

 

4) Confirmation

We will issue a confirmation of booking by email and include our invoice with that confirmation email. It is your responsibility to check this confirmation email, and to urgently advise us if there are any errors or omissions. Your rights may be affected in relation to any matter arising as a result of such error or omission if you fail to do so. Alteration or cancellation of the booking by you once a confirmation of booking has been issued will be subject to the charges outlined in the ‘Cancellation and changes to your booking’ section below. 

 

5) Cancellation and changes to your booking by you

Sun Active Tourism Ltd shall make your booking in accordance with your requested dates and activities. If more than 30 days prior to your arrival you need to change any details of your booking, we will do our best to assist. Alterations after this date will treated as a cancellation and re-booking. Additional charges may be levied if we are unable to recover costs already incurred (for example, transfers and tour deposits).

 

If you wish to cancel your booking after the confirmation email has been sent, you should contact us in writing via email to info@cyprusactive.com and we will try to meet the request. All changes are strictly subject to availability at the time of request. If we are able to make the change requested, a non-refundable administration fee will be payable, as well as  any applicable rate changes or extra costs incurred as well as any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers. You should be aware that these costs could increase the closer to the date that arrangements are to take place so you should contact us as soon as possible. 

 

In the event of a cancellation we may in our absolute discretion impose charges that exceed those stated below. The cancellation charges you will be required to pay will be calculated from the date we receive written notification of your cancellation:

 

Number of days prior to commencement of the arrangements cancelled when written confirmation is received by us: 

 

Prior to 60 days     ...   25%

60 to 31 days        ...   50%

30 to 15 days        ...   75%

14 days or fewer     ...  100%

 

6) Cancellation and changes to your booking by Sun Active Tourism

On occasion it may be necessary to amend certain arrangements or cancel them (for example, certain tours and experiences require a minimum number of participants before the tour/experience can take place and if this number is not reached the arrangements will be cancelled). We reserve the right to amend or cancel arrangements at any time. If we have to make a major change or cancel your arrangements, we will tell you as soon as possible and if there is time to do so before the arrangements are due to start, we will offer you the choice of i) (for major changes) accepting the changed arrangements ii) having a refund of all monies paid in respect of the changed or cancelled element or iii) accepting an offer of alternative arrangements of a standard comparable to the arrangements affected from us, if available. You must notify us of your choice within 7 days of our offer. If you fail to do so we will assume that you have chosen to accept the change or alternative arrangements. 

The above sets out the maximum extent of our liability for changes and cancellations and we regret we cannot meet any expenses or losses you may incur as a result of any change or cancellation. The above options will not be available if we make a minor change or cancel as a result of your failure to make full payment on time or where the change(s) or cancellation by us arises out of alterations to the confirmed booking requested by you. 

 

Sun Active Tourism reserves the right to change the itinerary, tours where circumstances dictate. We shall advice you of these amendments before your start date.

 

7) Force Majeure 

Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concerned’s control. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure. 

 

8) Liability

We will not be responsible:-

(i) where the arrangements cannot be provided or cannot be provided as described due to circumstances beyond ours or the applicable supplier’s control; 

(ii) where you incur any loss or damage that relates to any business activity; or which could not have been foreseen at the time you made your booking in the light of the information you gave to us at the time of booking; 

(iii) for any information about the arrangements that we pass on to you in good faith; 

In the event that we are found liable to you under these terms, our maximum liability to you is limited to the cost of your booking (or the appropriate proportion of this if not everyone on the booking is affected).  

We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.

 

9) If you have a complaint

Any complaints arising out of any arrangements must be reported to the relevant local supplier. If you wish to complain after the arrangements have been concluded, please contact Sun Active Tourism Ltd in writing within 14 days to info@cyprusactive.com. If you fail to follow this procedure there will be less opportunity for us and/or the supplier to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result. 

 

10) Health & Fitness

It is your responsibility to ensure that you have a reasonable level of health/fitness, adequate experience, suitable clothes/equipment and remain aware of risks involved in our activities. Although Sun Active Tourism Ltd can assure you that with sensible precaution your activities are as safe as possible you must accept that the sole responsibility for your personal safety remains with you. In the interest of safety you must undertake to follow the advice provided by anybody on our behalf and heed any warning or advisory notices you may encounter during our activities. Customers with pre-existing medical conditions (e.g. heart or back conditions) must inform us at the time of booking. We advise that if you are pregnant or have a heart or back condition, that you do not participate in our Sailing or Jeep Safari tours.

 

11) Disabled Clients 

We must be advised at time of booking of any disability and special requirements. Special facilities can be requested but may not be guaranteed. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details. 

 

12) Special Requests 

Any special requests must be advised to us at the time of booking. You should then confirm your requests in writing. Whilst every effort will be made by us to try and arrange your reasonable special requests but we cannot guarantee that they will be fulfilled.  The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met and it we will not be in breach if this contract if it is not.  We do not accept bookings that are conditional upon any special request being met.

 

13) Experience Images

The images used on our website to illustrate the experiences, particularly those that take place at more than one location, are used as an indication only. Whilst we have made every possible effort to ensure the accuracy of the information supplied, please be aware that the vehicles, craft, machines, animals and settings at each venue may vary.

 

14) Conditions of Suppliers

The services, which make up your booking are provided by independent suppliers.  Those suppliers provide these services in accordance with their own terms and conditions that will form part of your contract with us.  Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions.  Copies of the relevant parts of these terms and conditions are available on request from the supplier concerned.

 

15) Law and Jurisdiction

These terms of business are governed by The Turkish Republic of Northern Cyprus (TRNC) and the courts of the TRNC.
